What is the difference between probate and trust administration?

Probate is a court-supervised process used to validate a will and distribute assets. Trust administration is a private process managed by a trustee according to the instructions in the trust document, typically avoiding court involvement and maintaining family privacy.

How long does the probate process take in California?

A typical probate in California takes between 9 and 18 months. Complex estates, disputes among beneficiaries, or delays in court scheduling can extend this timeline significantly. We work to streamline the filing process to avoid unnecessary delays.

Do all estates have to go through probate?

Not necessarily. Generally, estates with a total value under a certain threshold or those held in a properly funded living trust can avoid the full probate process. Assets with designated beneficiaries, like life insurance or retirement accounts, also bypass probate.

Do trusts apply to all of my assets?

Trusts only apply to assets actually put into the trust. Your probate estate generally includes assets that are not titled in the name of your trust.
